But as the company faces a lawsuit, could this all come crashing down? The legal complaint is that the tech company’s generative AI training practices impact the rights of creators.
Nividia’s lawsuit is part of a triad of lawsuits filed by YouTuber David Milette. The YouTuber’s lawsuit seeks $5 million in damages not just for himself, but for other creators too.
Along with Nvidia, Law360 claims that Google and OpenAI have had similar lawsuits filed against them.
What is the Nvidia lawsuit?
In the Nvidia suit, Millette accuses the chip maker company of “scraping” his YouTube videos without his consent. He also claims that the company profited off the videos used to train its AI models. Furthermore, as Tubefilter points out, Millette also accuses Nvidia of “unjust enrichment” and “unfair competition.”
In a filing to dismiss the lawsuit, representatives for Nvidia claim that the Copyright Act overrides Millettte’s accusations. Lawyers for the company also argued that Millette hasn’t sufficiently proven that Nivida’s AI training practices are harmful to him. Furthermore, Nvidia’s reps argue that there’s “no plausible basis” to Millette’s claims that Nvidia used his videos to train AI.
